  • HELP!!! Need information on how to stop a person from reentry into the US

    Can you please let me know what form or, request to make to prevent
    someone to reenter the United States. The person who is trying to reenter left in March of 2012 after she was reported staying in the
    country over 122 to 125 days after her K-1 visa expired. (She just missed being picked up by ICE by fifteen minutes) She was supposed to return to her homeland on the 9th of November 2012 but didn't return/leave the United States to return home until the 12 to 15th of March of 2013. There are other circumstances with this person.
    Therefore please let me know the following;
    1) If a person left without being caught by authorities for overstaying on an expired K-1 visa by nearly four & a half months, how long are they banned from reentry into the United States?
    2) How can one request that this person become persona non grata? If it's possible what steps does one take to do it?

    Please let me know if it can be done either way. Thank you for your
    time on this matter. I look forward to your replies.

    Her previous overstay will probably result in her being denied entry to the U.S. if she tries to reenter.

    Beyond that barrier from reentry, there is nothing you can do without solid evidence of previous fraud or felony convictions. My advice is to let Homeland Security do its job and get on with your life.
