I will be receiving an immigrant's visa in order to take care of my spouse (a US citizen) who had a heart attack while visiting her family. As a Swiss visiting under a 90-day visa waiver, I was refused an emergency visa and forced to apply for a family-based immigrant visa even though it was not our objective to live in the US. The procedure has taken 18 months.
I understand that a Green Cards needs to be requested and paid for. If not done, the visa status will expire in 1 year. This may be acceptable but in case, we depart after 1 year, what would be the consequences should I NOT request a Green Card and need to re-enter under a Visa Waiver of 90 days for personal or business reasons?
