Hello everyone,
I would like to get some help!
Some background info..My parents have green card and are currently in US. Since Jan 2015 they have continuously stayed in US so far.
Anyways, they plan to visit India in Month of October, 2015. There length of stay in India during this trip is still not yet decided. If they decide to return in Feb-March 2016 time frame they can simply return back with their green card without any hassle. Now, lets say if they return in Feb 2016, can they immediately apply for re-entry permit and fly back to India in a month or two (after their biometrics test)? Does USCIS look at your most recent (last) 12 months US stay record when you apply for re-entry permit?
So my real question is: Is there any such requirement that says you have to be in US for minimum 6 months (continuous) prior at the time of re-entry visa application?
Also, another question that I have is: A person who has a re-entry permit, is he or she allowed to make multiple six plus months trips during the 2 year re-entry visa expiry timeframe?
For ex - A person's re-entry visa begins in Sep 2015. If he visits India in Sep 2015 and stay's there for let's say 8 months and comes back to US in April 2016. Again, decides to leave US in June 2016 and comes to US in Mar 2017. Like that...Is he allowed to do so with his re-entry permit visa?
Thanks in advance for all your help!!!
Cheers,
Nikhil
