  • visit once every 3-4 month...

    me+wife+daughter will be visiting in sep18 *first time* after getting GC (1 year temporary). i will then be leaving for my native country after 15 days stay.

    1. if then, i visit once every 3/4 months (each year) , stay over for 7-10 days, the leave for my native country - will it tantamount to abandoning & put my PR status/GC in jeopardy.
    2. will they question me on my second visit itself. (for short stay during first visit)

    i don't think it will look good if they see u stay for like 50 days a year in USA, u might have issues at some point either at port of entry , GC renewal or citizenship.

      This would likely fall under abandonment of GC, and it would most certainly hinder future naturalization.

        It's understandable that you probably need to get back to India to tie any loose ends, etc. If you feel you need an additional year or two before you can fully move to the US, then apply for a re-entry permit. That way you won't be wondering if there will be an issue at the port of entry. Just my 2 cents.

          err.. it would be like close to 40 days than 50...

          1. also, would they deny entry at my very second visit itself. (second visit in around 8-9 months after first)

          2. could i reason out saying, stay at native country for longer periods & frequent intervals, mandated by commitments: wind up existing business, monetise properties, clear liabilities...

            having to tie up lose ends in your home country before permanently moving is one thing, but this seems like you are not planning on moving to the US anytime soon, so the question now is if you're not planning on relocating in the near future, then why didn't you wait to file for your green-card instead of doing it now and risking the possibility of them considering you having abandoned your green-card due to not meeting the physical presence requirements?
