  • My parents work permit is about to expire, are they still allowed to be in the USA?

I petitioned my mom and dad last year, in June 27th. They got their work permits shortly after, but have not been schedule for an interview to get their temporary residence. Their work permits expire in January 4th, neither of them work as they are both elderly. But will this hurt or delay the process for them to become temporary residents? Are they allowed to stay in the country?

They can stay in the US for as long as their I-485 is pending. Whether they have an EAD or not is irrelevant.

This is my personal opinion and is not to be construed as legal advice.
