  • Can attorney apply for re-entry permit for me??

I have continued to do some research and found out, that this "abandonment" is not a very straight forward nor simple process. There is a very large grey area in there. And it seems that cases, which are almost exactly the same have been decided upon completly different.

I just had my biometric appt last year due to renewal of my LPR Card. Do I really have to be in the USA to file for re-entry. Can I ask an attorney to do it for me?

You need to be physically in the US on the date you file an application for a Re-entry Permit (i.e. on the day that USCIS officially receives it), as well as on the date for the biometrics appointment. At other times, you can be outside the US.

This is my personal opinion and is not to be construed as legal advice.

        Re-Entry

That is exactly what I thought but I was hoping that I had overlooked something. Thank you much for replying.
