  • I-751 filing

    Hello All:
I received my conditional green card in January last year, I just wanted to get a head start on collecting documents to apply for the removal of conditions on my gc. I have a few concerns I hope you guys can help me with.
    1. After getting my GC I got a job in another state, my wife is on a contract for a 3 years and cannot leave the place she is working hence we both are living separately. Will this be considered a red flag.
    2. We do have a joint account, but we both manage our finances independently.
    3. We have both listed each other as beneficiaries through our work in case of accidents.
    4. I plan to get a life insurance with her as a beneficiary to strengthen our case.
    5. We have a lot of pictures of travel along with 2 marriages one in the US and one in India.
    6. I have a record of travel to meet her every month.

With this knowledge how likely or unlikely am I to get an approval.

    Best regards
    Sagar

This knowledge is (absolutely no offense!) basically useless to tell you how likely it is that you'll get approved.

That form has a lot of questions on it & we know nothing about your relationship or your gc application or your history or anything.

    1. Yes it is a red flag. However, I think USCIS policy specifically makes exceptions for something like uncontrollable separation (not the term they use), like work. You should look it up & read it but basically I think you should just submit evidence that you have to be apart for work. Try to show that you have a plan for living together after her contract.
    2. You should both use the joint account, at least a few times a month, both putting money in and buying something.
    3. Good.
    4. Good.
    5. Good. You should also submit tickets and receipts and stuff. Even better if those purchases come out of the joint account.
    6. Good.

      Removal of conditions I-751 form

      Hello,

I am not sure where to post this or how to find the right topic. I have a conditional GC that is expiring in about 3 months, I obtained it through marriage to a US Citizen. However, since July last year things haven't been too good in this marriage and we separated in January. Last week we filed for divorced and it takes 60 days (in my state) for that divorce to happen, unless there are some other delays, which is what is stressing me out. Two weeks I also received a letter from immigration saying I need to file I-751 soon to remove conditions. I know I can file the application all by myself, since this is a marriage I entered in good faith and have all sorts of evidence to prove it. The question that I have is whether I can submit that application before the divorce is finalized or not? I mean, I assume immigration could do a request of evidence (since I would not have a divorce decree just yet). Waiting till I get the divorce decree, especially if there are delays that might make this process longer than 60 days and closer to my deadline makes me nervous. I don't want to file late or be out of status! Please advice!

      Thank You.
