  • Conditional Greencard

    Hey,

I got married in Aug/2005 and my wife adjusted my status and I got the Conditional Greencard in Jan/2006. I have to remove the Condition by Oct/ 2007 but i have a lot of problems with my wife and we will get divorce soon. whats will happen in this case when i apply to the removal of condition without her.

If you get divorced, you can't remove the conditions on your green card and eventually you loose your green card.

Thts not true. It can be done. You can divorce her and apply for a waiver. The waive ris the same form I-751 and you file it within the same time requirement. With the form, you send documentation showing that the marriage, although terminated, was entered into good faith and ypur divorce decree. Of course, be careful whats on the divorce decree ( let her file) If your Divorce is pending but not final, the waiver will be denied.

It might be good to use an expereinced attorney to do it but it can be done.
