    My son live in Brazil and want wait until finish college before move with me, he turned 18 years old past April, 2006.
    I have green-card valid for 10 years and I will be applying for citizenship (married based) in June 2008.
    I would like to know if I still going to have a chance to bring him here to USA, and if I do, how? Should I apply now even if he live in another country? or should i wait for my citizenship?

    Miriam - What are you planning to apply now? You can't sponser your son for GC since you are not a citizen yet. When you become a US citizen, you can sponser green card for your son. Since your son is already 18, he will not automatically become a citizen when you become a citizen.

      Thats not true at all. You can file for your son now before u become a citizen. When u become acitizen, then you can inform USCIS by sending them the citizenshp certificate. However even befor eyou get that though, why didnt your spouse petition for him same time as you? For immigration purposes hes a child of a USC ( your spouse) if the marraige toook plac ebefore his 18th birthday. That seems to be the case so your husabnd can go ahead nad file for him now

        Hi, i am a permanent resident here in california. My six year old son has an immigrant visa which will expire on Dec 15. I have a problem bringing him to US because I am a single mother and I cannot afford the fare (which is getting so expensive especially during December) for both of us considering that I have to go back to my country and pick him up. And when he will be here, It will be difficult for me to work because I have no one to take care of him at home. My question is, if his visa expires, can I still re - petition him as Legal permanent resident?Or do i need to wait till I get a citizenship and then petition him? hope you can provide me with some enlightenment regarding this matter. Thank you
