  • Bona fida marriage/Risk of denial!!!!!

    I have posted this on other forums.......

    I entered US on F1 visa (and I did want to attend the University) however , the my Fiancé who is waiting for his GC to be approved had asked me to marry him long before. We did not get married out of US because we are from two nationalities and getting the authorizations to get married took us ages.... we want to marry right away however, a lawyer told me that I should wait at least 90 days after my entrance as a F1 or my petition will be denied!!!! no matter what evidence and proof of Bona Fida marriage we provide for the Immigration Officer.......on the other hand within 90 days his GC might be approved!!! What are we suppose to do

    Your lawyer knows about the waiting period.
    I would wait as he adviced you.

    Even if His GC might be approved, He still can petition for you if you get married.
    I wouldn't wanna rush it. Just relax and wait as your lawyer advised you. You definitely wanna be in school to keep your F-1 status valid untill you get your green card which then voids the F-1 status.Don't rush things and you will be fine

      When you come into the US for another reason besides marriage (school, work, visitor), you have to wait at least 60-90 days so that USCIS does not accuse you of lying at the border and coming to the US with another purpose other than what you stated. It is a very serious offense to come to the US for school and then get married and apply for a green card right away, so I would advise you to listen to your lawyer. He/she knows what they are talking about.
