    Hello,
    I have red almost all threads concerning my question, but, seems like I am the only person in this kind of situation.
    I am a conditional green-card holder on the basis of marriage on my husband, who is US citizen, and my 2 year green-card is about to expire (I mean I have one and a half moungts before the 90 days time of GC to expire).
    I have told my husband yesturday, that it is the right time for us to start collecting the documents and prepare forms for the Form I-751. But I was shocked when he said "no". We never talked about it before, it was a "taboo" topic. We had some serious problems in our relationship at the very beginning, which I tried my best to make it work out for almost two years.
    For the last 6 moungths we did not have any problem in our relationships. But from yesturday on, he became rude and doesn't talk to me at all. I am afraid that when it is time to file the Form I-751, which is in the nearest future, he just will not do it. And I would not have an opportunity to file it on my own-because we are not divorced. I just do not know what to do.
    The question is:
    What will happen with my statuse in the situation if he refuses to file the Form I-751 with me? Do I need to file it alone?(we are not divorsed and lived together for almost 2 years) Is there any way out for now? and if I lose my legal statuse completelly, would I have any chance to gain the legal statuse again?
    We do not have documents with our both names, we didn't bye anything together, we have one car-which i on his name, we rent house, mails, everything is on his name, even electricity papers. The only documents we have is health insurance, which he recently applied because of some problems with my health an tax forms for our both names, but he keeps tax forms somewhere-I do not know were.
    Please, help with any kind of advice, as I am completelly lost. I can't believe it might happen with me. Thank you for your time. Waiting.

    With your kind of situation, I would consider hiring an attorney. Simply for his advice.

    This is because with you not being Divorced, You really can't file a Waiver. You gotta be divorced to do that.

    Another thing about your case is, You said you don't have enough documents starting your were in marriage for sure and not for a purpose of getting your card. Your Husband is playing the Game because I believe he understand he might be needed For filling the 1-751 Jointly. If You can try and do all you can to have him sign the Joint 1-751, That will make things simple and then ofcourse with your limited documents you will send with your forms, lets hope and pray you won't be called for an interview. Most people are approved without one.
    Consider asking him to put your names on those documents. If you filled Joing taxes, You can have tax scripts through contacting the IRS office in AUstin tx. For your case to go smoothly, Try make all you can to make it work since you are almost there anyway. Definately, it doesn't look like you will stay married to him for too long. Sorry to hear he is being an *******.

      Yes, he is kind of know that I depend on him for this Forms.
      He gives me clues(not saying stright) that he wants me pragnant firs, before this papers. We actually were planning pregnansy ni the nearest future after I go to my country to go through some doctors. This option is very limited in US for our health insuranse. But, I think I could risk now and have a baby.(I am not against to have a baby anyway). But I am not sure that I would be able to stand his character throughout of life.
      My question: If we get divorsed, and he will try to do everything possible to take a baby from me(through court). What are his chances? (if I am legal in US that time)and he is in armed forces by the way.

        If he his the kind of guy I think is his, And with the way is is treating you, I would make 100 % sure I don't get pregnant.

        You don't wanna put a baby through all that. If he really loves you, He wouldn't want to put you through this mess already. He seems selfish and I don't think you wanna be with him all your life has you stated. You gotta see if y'all love each other and ready for a long time commitment.

        If you can promise him whatever he wanna here and have him sign ur papers, then I think you might be better off than getting Pregnant and getting a little innocent baby in this mess.

        Try Buy time by going for counseling and see if that works! I feel 4 you!

            The court looks at the best interest of the child. So it really all depends on each situation. They Look at Finances, Character, e.tc. Basically, they try make a decision based on what will be good for the Child.
