  • When I can go to my country?

    Hello, everyone!
    I am a CR green-card holder through marriage to citisen and want to know:
    After I send a join petition letter to remove my CR statuse, can I go to my native country while I have 2 more months untill my 2 year gc expires? I need to go there anyway.., or should I wait for something to happen-the interview or anyth else? When should be the interview anyway? and when should I stemp my passport?, is it all after the time when my next 1 year green card expires? i just need to go to my country for one month, can i do that after I sent the petition letter?
    Please, give me an advice? Thanks.

    You will need to have your passport stamped before you can go out of the country or else you will have problems. Make an info pass with your local district office and have it stamped.

    One month shouldn't be a problem if you have your passport stamped with the temporary 1-551 stamp.

    Your conditional Green card expires on your second year anniversary. You are required to file to remove the conditions 90 days before it expires.

    Basically, It takes anyway between 6 Months to 12 Months to have your joint petition to remove the conditions on your GC approved and receiving your new Card. Most cases don't require an interview. Make sure you send enough evidence to have the Immigration officer convinced you are in a true marriage and not for the purpose of the card.

      I try to figure out when to go better then...
      Can I go to my country(overseas) while pending for removing of my conditional statuse, say-we prepare all forms and papers in advance and my husband will send them while I'll be in my country for one month. OR do I really have to phyzically be present in US while filing the joint petition for removing my conditions?
      Or, I just better go right after I send the joint petition (before my 2 year conditional GC expires)-not waiting for approval?
      This is 6-12 months waiting period, as you said-I can't wait so long.
      Say, if they would like to see me for the interview (I know I have to be in US that time), so I better go while my husband will be sending a joint petition?
      I just need one, or maybye one and a half month in my country. By the way, one of the reasons is changing my foreign Passport, course mine expired due to 25 yo. They say it will take 1 month to change there and I can't change it in US, course i still belong there. So I don't have the passport to stamp it anyways.

      My question: When(between two variants) is better to go? Do I HAVE to physically be present in US while filing the joint petition? And (in case they would want an interview with us), will they give the one year temporary GC to me anyway, and when-right after we send the joint petition, or I still would have to wait for it a few monghts?

        When you apply for 1-751, you are given the one year extention to work and travel if you wise. however, before you travel, you should make sure you have your travel documents. usually they stamp on your passport. if you have one which is expired, then if you make an infopass, the officer will tell you want you should do.

        After you apply for your removal of conditions, they really don't have to call you for an interview, if they are convinced by the information you send them as evidence. Try send as much Evidence as you can that way, you don't have to go for the interview. And your case will be approved faster.

        Going To your country for a month shouldn't be an issue. Just Make sure you have the right papers to go and come back with.
