  • Filed i-751, now what?

    My wife and I have filed i-751, petition to remove conditional residency for her green card. Everything went smoothly and now what? She got the extension and its all good. We have been married for 3yrs and 2 months. Can I turn around now, and just apply for citizenship for her? What is the time line before they are finished reviewing her petition?

    Any and all help would be appreciated!

    When you say everything went smoothly, Do you mean she got the 10 yr GC? If So, then you can File for citizenship based on the 3 yr rule since you are married and living together.

        Takes 6 to 9 Months. Once your 1-751 is approved, You can then Go ahead and apply for citizenship as you wait to receive your 10 yrs GC.

          So just to be clear...

          We have submitted our i-751, where she went in submitted the forms and had her photo and finger prints taken. she was granted a 1yr extension. So, your saying I can apply NOW for her citizenship?? Even though the process of the green card has not yet been completed, meaning she has not yet received the 10yr card?

          Im afraid to ask, but how long does the citizenship app take to be approved and she can get a passport and vote?

          Again thank you!!

            You can't apply for citizenship Now based on your statement "We have submitted our i-751, where she went in submitted the forms and had her photo and finger prints taken. she was granted a 1yr extension."

            When you said the 1-751 was all smooth made me kinda think you got it approved already.

            You Will have to wait until the 1-751 is approved before they can process the Form N-400 for citizenship. It takes 6 to 9 Months for the 1-751 to be approved. Once you Send in form N-400, it will take about 6 to 9 months to be approved also. She can vote after the N-400 is approved and goes for the oath and she is naturalized. Not until after the oath.

            Just kick back with your wife relax. You will eventually be able to apply for her citizenship.

              huh?

              In other threads on this forum, people have been saying that you have to wait 3 years after your I-751 is granted to apply for citizenship.

              But poisontee is saying something completely different.

              Who's right?

                You CAN file for citizenship even if your i-751 is still PENDING.

                You must have been a resident for 3 or 5 years (minus 90 days) since you first obtained the GC, either conditional or unconditional it does not make a difference. It is 3 years if you obtained it though marriage to an USC and you are still married and have lived together during all of that time.

                She can file for citizenship! I have no clue what the other poster is talking about...

                Filing for citizenship while the I-751 is pending is a known practice, since the I-751 could take a while. It is forced to be adjudicated by USCIS.
