  • e a Question regarding Deportation Rules...

I need help regarding my father.
    > My father came to this country in 1973 and lived here
    > till 2003. All the way through he was a legal resident
    > with a green card. My parents got divorced in 1986 and
    > due to domestic voilence issues (which is NOT TRUE)
    > was convicted to 3 to 9 years in prison. That was is
    > 1989. He was in prison till 1995 for 6 years and got
    > out in parol. He was eligible for parol after 3 years,
    > but my mother kept arguing that if he got out, her
    > life would be in danger. So he ended up staying an
    > extra 3 years in prison. He was living with me till
    > 2003 when one day he was pulled over for traffic
    > issues. Cops checked his license and there was a
    > warrant for his arrest, because according to
    > immigration he was a wanted man. After comming out of
    > prison, immigration started processing for his
    > deporatation. He hired a lawyer and was fighting the
    > process. I know there is a law where a green card
    > holder do more than six years in prison get to be
    > deported automatically. The thing is that law was
    > passed after 1994 and his conviction was before that
    > and he shouldn't fall under that law. He didn't have
    > enough finance to support a lawyer and the lawyer he
    > had ended up giving up on him. Immigration notified
    > the lawyer and my father 2 years before the
    > deportation regarding the final process. My father
    > never got the letter (immigration had an old address)
    > and lawyer never informed him. My father got deported
    > in July of 2003 to India. My question to you is:
    >
    > What can I do to bring him back to U.S.? Is there
    > anything legally possible to bring him?
    >
    > I have a family now and I know it would make him very
    > happy to come here one more time and see all his old
    > friends and family. Also he could spend time with my
    > daughter, his grand daughter.
    >
    > Any help is very greatly appreciated
