  • file for removal of conditions on residence without a joint tax return

I will start filing for the removal of condition on my 2yr green card this june, since my conditional green card expires on september, and we currently have joint credit card account, bank account, car registration and insurance, email and cards he wrote me a while back since we were dating, i also purchased a life insurance with my husband being the beneficiary. however, we run into major problem here, his parents would not approve of our marriage and i know this sound like a joke but, my husband's dad took his W2 to the tax preparer lady and had her prepare the tax for my husband, the ridiculous thing is that, my husband's dad has always assumed that were not married , and we just living together as bf and gf (thanks to my husband who never had the courage to come clean ) and my husband actually signed that paper as being single since he was afraid that his dad would find out about our marriage and get mad . I havent filed taxes on my part yet, but plz tell me would that take a toll on the removal of condition on residence when we file for the I-751 form? If yes, how do I fix it? I'm too confused right now i called my tax preparer and he said joint tax return is a major paper and they would definitely ask for it and from what i've told him he said most likely they will flat out deny my application, because, once again, this whole thing sounds like a joke, I had a hard time even coming to believe it myself . Your help and expertise will very much be appreciated. I am still trying to gather myself together and study for my exam, phew, bad thing just keep on accumulate.

Tell your "husband" to grow some "genitals". If he really cares for you and does not want to see you deported... then he needs to "man up" and let everyone know.

You could probably do "OK" with all of the evidence you guys have already. Without submitting a joint tax return. HOWEVER. The problem is that is he is filing as SINGLE, that is suspicious (specially since it is recommended for most couples to file as Married filing Jointly [better benefits and deductions]). He can still file as single, it is up to him really. But this will arise suspicions (and the I-751 Officer will look into this even if you two do not submit tax papers).

A joint return is a GREAT piece of evidence for a I-751 application.

Has he filed taxes yet? or he just had them prepared?

You two can still file together. But seriously... tell him to stop being a boy.

thanks so much for your advice, yup he already filed it, and it seems like theres no other way to talk him out of it though my tax preparer said that we could file for an amendment, but this guy is hardheaded and would not hear me out. So would that be a good idea to file for tax return amendment? I am still debating if I should as for an extension but it seems like that would'nt help if I can't get the copies of the tax papers ( his parents have them and he's too scared to go ask them for it). Thanks again for you help, I really appreciate it.
