  • Need advice on Retaining Greencard for my child

My wife and I have three kids ages 7,5 and 5 mos. The eldest is a permanent resident while the my other kids are citizens since they were born here in the US. My wife and I plans to stay in the US while the kids live in my home country until we become citizens. We are going to visit them often until we can apply for citizenship. My question is, since my older kid is the same status as my wife and I if she stays there for about 5 years will she be having problems in returning back here in the US?

    Thanks for you advice.

the laws apply to your kid as well. if the permanent resident kid leaves for more than 1 year without a re-entry permit, she will lose the permanent residency. she can stay abroad up to 2 years with a re-entry permit but that is the maximum.

i think this will be a pretty bad risk to take with her GC, even though you could sponsor her for a GC if she is under 21 by the time you become USC.
