  • Got 10 yrs GC and now problem with Marriage.

    Hi,

    I got 10 yrs GC after filling I-751 and now I am getting problem with my marriage so I am confused if I will get divorced then will I be able to apply for citizenship after 1 yr or (3 yrs all together)? or at that time I need to send all the docs same as together with my wife which I sent at the time of I-751.

    please guide me.

    If you divorce or separate from your wife you will have to wait 5 years (instead of 3) from the date your residency was approved.

      ohh okay, then I dont mind to wait 5 yrs. But after 5 yrs I can apply without her right? I can apply with only my docs. and it wont be any problem with 10yrs GC to stay and work etc.

      and is that 5 yrs including these 2 yrs which I already spend. or extra 2+5=7 yrs al together..

        You do not need her to apply for citizenship. Citizenship is not "sponsored" by her... the only thing was that you could apply for it earlier... but not if you separate.

        One qualifies for citizenship on your own merits.

        Yes, you can apply after 5 years (counting the past 2 years as a conditional permanent resident).
