  • Domestic Battery and Conditional Green Card

    Any info/opinion is appreciated:

I am a conditional green card holder through petition from my wife. My wife and I got into a stupid argument in a parking lot and later in a brief physical fight in which my wife was slightly hurt. Somebody noticed and called the cops. Both my wife and I ended up in jail for the night as my wife hit me first. The next day, we did not have to face any court or judge and were informed that charges were dropped. My green card expires in one and half year. After doing an intense online search I am not getting a good vibe on possible consequences. Can any body provide a knowledgable opinion if I am looking at deportation or denial of greencard renewal?

    Sincerely.

It has to be declared in the forms as an arrest. As no charges/convictions has happened, you are not guilty until proven so in court.

You will be fine but talk to an immigration lawyer as you could be held against CIMT even if not convicted but you agree that you did that in front of immigration officer.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
