  • Is there a risk for my GC if i stay abroad for 6 months

    My husband and myself are green card holders. We came to India on vacation on 25th Nov 2008. Recently my husband left for US after 3.5 months. On arrival, the immigration officer said that there is a law to cancel the GC if the stay abroad exceeds 3 months and he has the right to do it. The officer gave my husband a warning and let him go. I am still in India and booked my tickets to US for 15th May. Now my question is, is there any such law to cancel the GC if the stay outside US is beyond 3 months. Will i be in risk though i return before the completion of 6 months. Please advice. Thanks.

    there is no such rule. But there are rules as far as being gone for more than 6 months, 1 year or up to 2 years (minus 1 day).

    Basically, you need to maintain your resident status in the USA. Not be living in India.
