I am a green card holder since Sep. 2008. I really want to maintain my Green Card because I am preparing to live in the U.S. permanently. However, for some circumstances I can't leave my native country in the present, but I am sure that within the next five years (at most) I will settle and work in the US permanently. Therefore, when I was in the U.S. for the first time I applied for a re-entry permit. I didn't know that there was an interview for this application, so I stayed in the US between 3 and 4 weeks only and returned back to my native country. After 2.5 months my relatives who live in the States told me that the USCIS determined an appointment of the interview for my re-entry application. In this time it was very hard to me to return to the US again. As a result of this, my application has been denied. Because I was preparing to return back to the States after two years (based on my request for the re-entry permit), so I couldn’t travel to the States before 11 months of my first time. I actually traveled in Sep. 2009. I was really lucky because the immigration officer at the airport didn't ask me anything, he just took my fingerprint and photo, and so I could enter to the U.S. without any problem. I stayed 3 weeks and returned back again to my native country. I don't want to be in a risk again, especially that I like to be very honest with the immigration officers. Therefore, within the next 4 or 5 years I will travel to the U.S. every 6 months even for 2 weeks in every time, until I finish all my business and duties in my native country and start to live in the U.S. forever .
Now I have some inquiries, would you mind please helping me?
1- is it possible to apply again for a re-entry permit from my native country and travel to the States at the appointment of the interview or not?
2- I will file the Income Tax Return Form (Form 1040). Is there any problem if I say that all my income is earned outside the U.S.? The accountant who will file the Income Tax Return for me asked me about the name of the company which I work for in my native country and its address. Is there any problem if he mentions this information in my tax return file because this information proves that I work outside the U.S. at the present? Or you advise me to not mention that? Does this information have any negative effect when I ask for a citizenship on the future? If yes, do you advise me to not file my income tax return at the present or what? ? Especially that I know many cases got their green card before me and have never filed their tax return before and don’t face any problems until now.
3- Is there any risk if I travel to the U.S. for about 2 or 3 weeks every 5 or 6 months just in the next four or five years at most and then live in the U.S. permanently?
I wonder if you could help me and answer my questions. Thank you in advance for your concern.
