  • Salary after Employment based Green Card

    Hello,

After getting Employment based Green Card in EB2 category:

    1. When is the LATEST you should start working for sponsoring employer ?
(e.g. If card received on 3rd of the month, do you HAVE TO start same month or can wait for a month or so ?)

    2. If salary, after GC, is lesser than mentioned during Labor stage, what problems will it cause for:
    - GC renewal ?
    - US citizenship ?
    - Other problems (GC Cancelation, Deportation...) ?

    3. What if, after GC, sponsoring employer gives termination letter with:
    - NO reason ?
    - reason stating bad economy ?
Please tell, for each case, what problems will it cause for:
    - GC renewal
    - US citizenship
    - Other problems (GC Cancelation, Deportation...)

    4. If the salary after GC is less, does it matter if category was EB2 or EB3 ?

    Thank You.

    1. ASAP. The sooner, the better as that is what the GC was for.
    2. All of the above as the entire petition can be considered fraudulent.
    3. Depends on when the letter was issued and if you were working for the employer prior to getting the GC. If you have never worked for them before or after getting the GC, the chances of the petition being considered fraudulent is very high.
    4. Does not matter which category.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

      Thanks.
      1. I have worked for more than 5 years for sponsoring employer. So is termination after GC safe ?

      2. What is minimum duration at which one must get paid at I-140 rate ?

I spoke to a laywer who said "Generally several months. Minimum 2 months".
