  • Last name on passport and green card does not match (not due to marriage)

I have read on the forum about lastname doesn't match with green card due to marriage, I have different situation.

I came to US and applied green card. However, during filing process, my parents changed their last name, and in my country, since my father is head of household, my last name automatically changed. I have been through RFE and writing affidavits about my last name change and finally received my green card with "old last name". How do I proceed to have my green card updated? Can I just filing I-90? Do I need to go to the court about this?

    Thank you,

You will need to file I-90 to get a new green card.

If you went through RFE, and USCIS had the new name but the card was still issued with the old name, then I believe they should replace the card without you having to re-pay I-90 filing fees.

You should check with them on that point.
