Green card holder study in abroad and reenter usa after 1 year of study

  • Green card holder study in abroad and reenter usa after 1 year of study

    Hi,

    My family(me, my wife and daughter) has Green cards. My daughter has got admission in France university to study International Business for 1 year.
    As she has to stay in France for 1 year to study, can she come back to USA without any entry issues at POE?
    As I hear there is a rule that only 6 months of stay in abroad is allowed and remaining 6 months in a year person should stay in USA.
    What are her options to stay in abroad for more than a year to study and then come back to USA without any problems to continue her GC status.

    She needs to get a re-entry permit before travel, more info:

    Nov 2018 - Package sent - EB - Texas Service Center
    Day 1 - Package received at the lockbox
    Day 999 - Card delivered to me - Aug 2021

      Thanks for the reply Enub4. Can I submit Reentry permit form online or send by post to USCIS? How long will it take to get the re-entry permit?

          Hi

          For LPR to stay in overseas the limitation is 12 months actually 11 months and 29 days but noone would do that ,especially with the current government . but IF you stay more than 6 months meaning 180 days USCIS will count you as you spent the whole year abroad meaning you were absent for 365 days of the whole year .therefore you will loose your entire year and if in case you plan to apply for u,s citizenship in the future.

          For your daughter to go and study in France for 1 year , the best choice is to apply for 2 years travel document for refugees or stateless people and also called as a re-entry permit and in that case she can come back anytime during that 2 years and still would be questioned by CBP .
          once you have a travel document which is like a passport and even if you dont have a passport a travel document is good for re-entry to U.S


          To get a 2 years Re-Entry permit you must apply to the nearest USCIS branch with an info-pass and it would take 90 days or longer to get an answer so DO NOT LEAVE before you apply and receive the 2 years Re-entry permit .You need to file your application by mail at the USCIS Nebraska Center .
          She can also do it without a 2 years re-entry permit but than she must come back in and out U,S about 4 times during her 1 year study in France which wouldnt make sense and also cost you more money and more screening at the POE
