  • Green Card still valid?

    My wife is a Canadian citizen who got permanent resident status as a child at 8 years old. Since then, her family have moved around a lot, living in several countries (Mexico, France, Spain). Every year she spent several weeks of the summer at her Aunt's in Indianapolis - except when she was 17.

    When she was 18 she moved out of her parents place in Spain and came to live with her Aunt in Indianapolis. About a year later, she moved in with me, we got married, and have been married since December 2004. We now have 2 children, born in the U.S. I am a U.S. Citizen by birth also.

    With all the moving as a child, did she lose her status as a permanent resident? She has been living here with me as if her status was legal, we didn't realize it until we started filling out the citizenship application that she may not be a valid permanent resident anymore. What is the likelihood that she will be deported when she applies for citizenship based on living and working in the U.S. without a valid permanent residence? What about chances for the citizenship application being denied? We have never been informed that her permanent residence has been revoked, but she did get a warning noted in her passport on her last re-entry (when she was 18, moving here the final time)

    Is there anything we can do to fix the situation?

    Do we need to hire an attorney?
