    Hello,

    My mom left almost 3 years ago because her husband got sick and we've had some other illnesses in the family with my grandpa and uncle, she has been helping take care of all of them. She did not file for the permit to leave the country. Her green card is unexpired but in October it will be three years of her being outside the country. What do I have to do to obtain a re-entry permit for her and what supporting documentation do I need to submit and also about how long does the process take for approval or denial?

    You can not apply for a re-entry permit after the fact. She can apply for a SB-2 visa though. It is relatively hard to get and it might be easier to just apply for a new green card. She can also take her chances and just fly back to the US - CBP might take her green card at that point and send her before a judge to argue why didn't abandon her permanent residency.

        Hello Guys.

        My Parents has Green card but after staying for 3months in USA they went back to home country (India) as my mom was not feeling well n underwent treatment in India. Its been 3.5yrs they are there in India n now want to come back to USA.


        My questions :
        1. What will happen if they try to enter in USA after 3.5yrs ? We dint apply for Re-Entry permit that time.
        2. Will they allow to board the flight at Home country (Indian) airport and at any layover airport??
        3. Will they give entry at US border ? (We dont hv Re-entry permit or anything but we have documents to show that my mom was sick and was under treatment in USA as well as in India )


        Could anyone suggest/ give inputs on this if someone has gone thru this kind of situation?
