  • Change of address/removal of conditional

My wife received her marriage-based green card in January 2019 after a 3 year overstay on a tourist visa. I am a USC and her sponsor. She will be eligible to apply for removal of the conditional green card in October 2020.

We moved from northern New Jersey to New York City (which changes our USCIS office) in mid-June 2019. The day we moved, we submitted the AR-11 change of address online, but never received a confirmation number. I followed up on this this week and after my wife called USCIS's hotline, we learned that they had no records in their system of the AR-11 being submitted. The agent my wife spoke to on the phone seemed apologetic and was able to fill out the AR-11 for her today while on the call, but this is now 3.5 months after we moved. The agent was unaware of the date we had moved - my wife simply told him that we tried to submit and it didn't work. I understand the immigrant spouse is supposed to fill out the AR-11 within ten days of moving (which, per the above, we did, but again it wasn't processed). I'm wondering if this is going to create a problem when it's time to remove her conditional - or could it even create a problem sooner? I also just found out I should have filled out an I-865 for the sponsor change of address too within 30 days - I'll be sending that in tomorrow.

None of this seems like it's hugely serious, but I am wondering if this could create an issue down the road now that we've informed USCIS that we changed our address late. Anyone have experience with this? Thanks.

It's not serious. She can file the change of address again to make sure. A bigger worry might be that some correspondence might still be sent to the old address, so hopefully you have mail forwarding.

This is my personal opinion and is not to be construed as legal advice.

      >>>> Confirmation numbers are immediately received and an email is also sent if you gave your email address. It is clear that the process was not followed and therefore you do not have a confirmation#

      >>> It's OK. You made a mistake and tried to correct it. I doubt this will ever be an issue. If it comes up, you can explain at the interview.

      >>> Yes, this needs to be done asap.
