Received I-797 extention of GC, but lost the expired GC.

  • Received I-797 extention of GC, but lost the expired GC.

    Hi guys,

    I sent my I-751 form and I received the I-797 notice. The I-797 notice says you can use the notice together with your expired Green Card to travel. The problem is that I lost my expired Green Card.

    Do you guys know what I have to do? I am traveling overseas in May.

    I am pretty certain that you have to apply for a replacement green card prior to your overseas travel. You will need it to get back into the country. I-797 notice is an 18 months extension of your green card not it's replacement.

      It is just weird to apply for a replacement of an expired green card.

        See if they will give you an I-551 stamp. Usually you will need to file I-90 for a replacement card before they will give you an I-551 stamp, but in this case since you have a 2-year conditional card that is expired, I don't think you can file I-90, so hopefully they will give you an I-551 stamp anyway.

            If you guys are curious about it I just spoke to USCIS on the phone and they confirmed with me that I eligible to get a I-551 Stamp and travel with it. (that is what they already had told me I guess when I first submitted the I-751.

            So if you have a I-797 notice and you lose your temporary green card, they make an appointment with you to give you the stamp.

            They said I should expect a call in 1-3 business days to schedule the appointment.
