    I have a question and wonder if you would be able to help. Can I apply for naturalization on the second anniversary of my conditional green card? The USCIS officer at the time of my interview said I can file it concurrently but on the N400 online filing, it doesn’t allow me to do so. It needs another year. He said so because the process for removal of condition will take longer than naturalization. I have been a student since 2009 and have legally stayed in US for the past 10 years. Can it be considered lawful permanent residency? Thanks for directing me to the right information.

    You can only file the N400 after you have been a LPR for three years and married to the same US citizen spouse. What you can, however, do is file the N400 while the i751 is being adjudicated. My situation is as follows: I gained LPR status in July 2018. I would be eligible to file the N400 in April 2021 (3 months before my third anniversary as an LPR), but I had to file the i751 in April 2020. You can only use the time you were a green card holder, not any other immigrant or nonimmigrant status.

      Alright. Thanks. My husband and I were confused with the statement the officer made during the interview. I think it is now making more sense.
