Please help applying for Returning Resident Visa

I am a Canadian citizen, and a Permanent Legal Resident of the U.S. I have been in Canada visiting family, on an extended stay, because I became ill. I am now well enough to return to the U.S. and have discovered that I think I must apply for a Returning Resident Visa. I was unaware of the travel restrictions. So, because I was ill and unable to return, even though my intent was to return, I should be able to apply successfully for this. Is that correct.

It was a treatable mental illness that has been taken care of with medication, but unfortunately the whole diagnoses and gradual treatment has unexpectedly extended my stay to 2 years and 9 months. Will this much time be a problem.

I have an 11 year shared residence, and live in relationship with an American citizen, to whom I will be returning to in the U.S. I have never spent much time outside of the U.S., other than this trip, and I have been a Permanent Legal Resident for 20 years.

While in Canada, I was able to go on healthcare temporarily, because I was there for more than six months. Could this cause a problem with my application. Also, could this, now treated, illness affect my application.

Most definitly they will question you as to why you were out for that long, you will have to disclose your medical condition. I do not know if that will play a part in granting you re-entry.

I do know that when you apply for a GC they have question about history of mental disorder / treatment, So I believe that it does play a part in their decision.

They may ask you for additional documentation to evaluate your sitution.
