I had a re-entry permit which expired in August 2019. My last departure from the US was in August 2018. I am applying for an SB1 Visa, my appointment is on Monday 30th Nov in the UK. The case I am putting forward is that:
I received my greencard in 2003 through the lottery. Since then I have only lived in the US for 800 days. Will that count against me? I am wondering how strong my case is to get my greencard back. I want to desperately continue my residency. Any advise would be great
Thanks in Advance
- My trip to the United Kingdom was a “temporary visit abroad” as I had a specific reason for traveling abroad temporarily to finish already commenced in vitro fertilization treatments and its ending was fixed by a particular event, conceiving a child.
- My reasons for remaining abroad were beyond my control and for which I was not responsible (a) requiring classical caesarean section surgery to deliver my daughter in 2019 and (b) global pandemic which made travelling impossible at the time due to uncertainties and daily changing restrictions by government.
- Proof of my ties to the United States and my intention to return by filing my taxes, maintaining an address, bank account with credit card, family ties and continuing to look for employment
- My medical diagnosis going back to 2017 regarding uterine fibroids that needed removal with surgery in 2010 and 2017.
- I am close to getting employment in the US having completed final stage interview and another pending second stage
