  • Reentry after 3+ years (Card expires in 2027)

    Hi,

My old parents are outside of the country since August 2017. Currently they are living in Asia. They have valid Green card which expires in 2027.

We are planning to bring them back due to COVID situation in south Asian countries. Technically, they are not meeting residency requirements and we have not filed income tax for them each year as they don't have any income.

I'd like to know, if reentry is allowed at the port of entry (seattle)? Do we need to submit any re-entry permission before or at the time of travel?

Consulate is closed at home country in order to apply for new tourist visa. I am worried that parents cant onboard to a plane or they will be deported from the Seattle.

Any thoughts what are right next steps ?

    Thanks!

Given your family has been out of the country for so long and they haven't filed income taxes, there could be some significant difficulty at the border. CBP may pressure your parents to sign an I-407 (Record of Abandonment of Lawful Permanent Resident Status)- which they should not do under any circumstances. More than likely they will be admitted and handed a notice to appear and an immigration judge will determine whether they have abandoned their LPR status. It might be an idea to connect with an attorney beforehand.
