    I can't believe I have been such an idiot but I'm 7 months late filing my i-571 to remove conditions on my green card via marriage. I misunderstood the process. I thought that removing the conditions was only nesecarry if I was going to divorce. We're still married and have a child now. My plan was just to file for citizenship at the 3 year mark but when I looked at my green card today I found it was already expired.

    My son was born right around the time I should have been submitting my form and both he and his mother were hospitalized after the birth so that definitely distracted me from checking up on the details along with worrying about covid. I'm not sure that will be an acceptable excuse though.

    Had anyone successfully submitted an I 571? Did you go to court?

    I will be talking to an immigration attorney on Tuesday to get professional advice.

    You basically just need to collect all information proving your marriage is bona fide, file i751 and include cover letter with detailed sincere explanation why you are filing late.
    no big deal. Just take it seriously and do it ASAP.
    Also, don’t travel abroad until you get your 18 month extension.

      Thanks. I was hoping that would be the case. I am compiling evidence right now and I will consult with an attorney asap then submit.

      I'm confident in my evidence of our legitimate marriage. I'm just worried that my excuses for late filing might seem weak.

        Hi Rvabdb,

        I highly suggest you consult a lawyer about your case since your Greencard is expired already. I751 must be filed BEFORE the expiration.
        (c)(9) - AOS, Current filing I130 I131 I485 I765, PD-12/21/18. Same-sex couple.

        12/21/18 - AOS package delivered to Chicago office via FedEx.
        01/03/19 - 4 NOAs received.
        01/05/19 - Bio notification.
        01/14/19 - Bio done.

            If you misunderstood the process, that is fine. Mention that. Tell the truth. I would definitely mention your son and wife both got covid, etc. (Hope they are OK). Make sure you include evidence since the date of your marriage. Best wishes,
