  • Submitting i-751 application soon - what to expect?

    Hi there,

    My conditional gc was approved in 2019 and will be submitting documents for the i751 application soon.

    Are there any tips on how to handle this application? Any document suggestions to submit? We have the rent lease, rent insurance, internet bills, electricity bills, 401k for each, joint bank account statements and tax returns, to name a few. Did you submit affidavits? How many affidavits did you submit?

    Also, will there be a 2nd interview before the permanent gc is approved?

    Would love to know your thoughts and any additional helpful information on what to expect! Thank you so much.

        Congratulations.

        It sounds like you have a good bundle of strong evidence there. I submitted most of what you said you did. I did submit one affidavit, but it's not required. I just like to cover all of my bases.

        In regards to the interview, it really depends.

        Here is the USCIS guidance on it:

        Generally, USCIS officers must interview a conditional permanent resident who is the principal petitioner on a Form I-751, unless the interview is waived. This guidance explains that officers may consider waiving an interview if they are satisfied that:
        • They can make a decision based on the record because it contains sufficient evidence about the bona fides of the marriage and that the marriage was not entered into in order to evade U.S. immigration laws;
        • For Form I-751 cases received on or after December 10, 2018, USCIS has previously interviewed the principal petitioner;
        • There is no indication of fraud or misrepresentation in the Form I-751 or the supporting documentation; and
        • There are no complex facts or issues that require an interview to resolve.
        For us, they waived the interview on the I-751 and the 10 year GC just arrived in the mail when I least expected it.
        Marriage AOS - 2018

        4-10: Sent to Chicago Lockbox
        4-12: Arrived in Chicago
        4-14: Picked up by USCIS
        4-19: Email & text notifications received
        4-23: I-797 Receipts received
        4-27: Biometrics notice received
        5-10: Courtesy letter for I-693
        5-11: Biometrics completed
        6-04: Interview scheduled
        6-09: Received interview letter
        7-10: Interview complete & approved, status change to New Card being Produced
        7-13: Card was Mailed
        7-18: Green Card in Hand

          How long did you have to wait for the 10-year GC to arrive in mail after you mailed the application?

            We mailed it in April 2020, in the 90 day window, not long after received the 18-month GC extension.
            Received the GC in mail early September with no interview.

            Pretty quick considering COVID year. Our case in general is very simple, no complications and lots of primary evidence, and we met the conditions I posted above, which is why I think we got lucky and didn't have to have the interview.
            Marriage AOS - 2018

            4-10: Sent to Chicago Lockbox
            4-12: Arrived in Chicago
            4-14: Picked up by USCIS
            4-19: Email & text notifications received
            4-23: I-797 Receipts received
            4-27: Biometrics notice received
            5-10: Courtesy letter for I-693
            5-11: Biometrics completed
            6-04: Interview scheduled
            6-09: Received interview letter
            7-10: Interview complete & approved, status change to New Card being Produced

              Amazing. That was fairly quick considering COVID! I do dread the long waiting game, but your case keeps my hopes up! We will be front loading our application with plenty of joint evidence. Hoping for a quick and smooth application like yours!
