  • I-751 Time!

Hope y’all have been great! It’s that time again, dealing with the USCIS paperwork. I adjusted status in Jan 2020 via marriage (less than 2yrs at the time of interview) and I’ve now entered the 90-day timeframe for submitting the I-751. We’ve since moved to Texas, so I’m not sure which processing center will handle the app. Hopefully the Texas one because it shows 6 months processing time.

Will we need another interview? I’m also gonna be eligible for citizenship this time next year, but I think the I-751 will be adjudicated by then. Good luck to everyone!

    Timeline:
    Original PD: Sept 2018
    Interview: Jan 2020
    GC received: Jan 2020
    Mailed I-751 packet: Oct 2021
RoC (I-751) Application, filed from Houston TX
10/24/2021 - USPS delivered the package in AZ
10/27/2021 - Text from USCIS with receipt number, check cashed. Assigned to the Texas Processing Center

INITIAL AOS from F-1, married to USC, filed in Seattle WA

09/24/2018 - Package delivered to PO Box (PD)
    10/22 - Early bio walk-in
11/15 - New card is being produced (I-765)
    11/26 - EAD combo & SS card
    01/13/2020 - Interview
01/23/2020 - Case Approved, Card Mailed.

Some of them have interviews, and some don't. The I-751 can take close to 2 years and will almost certainly not be adjudicated by the time you are eligible to apply for naturalization under the 3-year rule. If you wish to apply for naturalization, you can file N-400 when you are eligible even if the I-751 is still pending.

This is my personal opinion and is not to be construed as legal advice.

Forgive my ignorance but where is the 2yr coming from? The Texas processing center shows 5.5-9.5 months now.

It's not filing time for I-751 for me,yet- coming up next may,but I have a question and hope, someone can help me with that:
Do I need to submit the Fingerprintcards when I apply from within the US? If so,why will there also be a biometrics appointment? I'm confused ????

Fingerprint cards are only for members of the military or government who are stationed abroad, since they don't do biometrics. Normal applicants do not submit a fingerprint card.

This is my personal opinion and is not to be construed as legal advice.

ideally you should submit the $85 fee for biometrics (fingerprints) when you file the i-751. most of the time, they waive the biometrics appointment since you recently did it with the green card filing, and they do keep the fee.

i suppose you could not include the biometrics fee, but they would send you a notice, pausing your case, pending submission of the biometrics fee, which will delay your i-751 filing (not worth it, IMO).

One more question: in the form the question about having kids- do I need to include my stepdaughter? Or is it just,if we have kids TOGETHER, recently born???

While every experience is unique. Here was my experience. I'm based in Oklahoma. GC also through marriage and less than 2 years at time of applying. My whole process took a little over 3 months. Fingerprints were reused, was not interviewed and card was just sent. Mind you I was approved on 11/10/2020 so definitely during a massive wave of covid at the time so that could have played a major roll. I then applied for Citizenship like 9 months later where I pretty much resubmitted all the same evidence as I did for my removal plus a couple of things that happened in the between time. If case is simple would recommend filing yourself via their online application! That process took me 6 months and I became a citizen in feb 2022. My 751 and citizenship has been a million times quicker than the initial GC application that took way over a year! Heres hoping something similar to you in Texas!
