I am getting mixed info on whether I should be getting social security (American ex husband-married 18 years) while I am awaiting my new replacement card. Am immigration lawyer says yes and SS says no. The staff at the local SS office are very young and have poor attitude when challenged.What can be done. I am starving here.

That depends upon whether your husband is alive/disabled or what
other situation is such as your age, for how long your husband
worked, how much he made etc.

receiving social security while waiting for replacement permanent

I don't see any problem why you should not get social security benefits
while waiting for replacement permanent card, if you are eligible in all
other aspects.

Permanent residence status is different than the proof in terms of plastic card. Even if you don't have the permanent resident card, as long as you a valid permanent resident, your status remains that and you have all the rights and obligations of the permanent resident. The plastic card is simply a proof that you are permanent resident. Not having a physical card does not stop you from being a permanent resident.

Even though this may not be an accurate comparison, but compare cash vs bank statement. Cash itself is an actual money and if you lose or give it to someone, it is gone. While a bank statement itself is not an actual money, but a representation of money that you have in the bank. The same way the possession of the card itself is not the same as being permanent resident

Am resident alien divorced from U.S citizen after 18 years marriage.He contacted me earlier this year to apply for my social security. Everything was in order until S.S fired back that the permanent residency card (10 year cd) had expired and that I wasn't able to get SS until it was updated. Two points; An immigration lawyer told me that she had had to sort that mess out a few times and that S.S should know that though the visa needed replacing because it had expired I had not. In other words I am entitled to full S.S as i wait for the replacement card which will involve three months and an expensive plane fare and other transportation costs when I get my appointment in the main island of Hawaii. I live on another island here and Oahu is the main island for most government.

The second point is that though our local S.S office is aware of this they refuse to act on it. We consulted with a social aid worker who irons out problems for people who are having problems with this and similar problems. She has a B.I.A degree but along with the immigration lawyer she is being ignored by these very young people in our Social Security office in Hilo Hawaii 96720.
