  • taxes after GC expired

    Hi,

I let my 2-yrs conditional GC expiring as I moved back to my home country
    It expired last summer

What is my status now? Do I need to notify US of anything?
At the moment I am not looking forward to renew the GC.

I am asking because because I don't know if:
    • I still have to file taxes in US even if I don't have an income in US
    • What to do if I want to travel as tourist to US
I read somewhere even if my GC expired I still have to file Federal taxes, is this the case?

You are subject to US taxes on your worldwide income until you file I-407 to definitively relinquish your permanent residency.

This is my personal opinion and is not to be construed as legal advice.

Few extra points on dealing with I-407.

      1. There is no filing fees Form I-407.

      2. As per instructions in Filling this form given in Part 1.
      Item Numbers 14.a. - 14.c. Certification.

You must sign Form I-407 before DHS or DOS accepts it.

      3. USCIS expects the documents back. Instruction in Part 1. Item Numbers 12.a. - 13.d. Documents Returned and Location of Submission

Submit all Permanent Resident Cards, reentry permits, and/or refugee travel documents in your possession.

Thank you for replying and instructions.

What is going to happen if I don't file I-407 ? What is my status considered now?

Filing taxes does not add any expense on my side, so it's not bad for me to keep filing.
Am I getting in any trouble if I don't file I-407 and keep living abroad, filing US taxes?

It's not just a matter of "filing" taxes, but also reporting your worldwide income on US tax returns, and paying US taxes on your worldwide income (or having to claim Foreign Earned Income Exclusion and/or Foreign Tax Credit on your foreign income). And your foreign bank accounts over $10000 will need to be reported to the US every year.

Residents of the US are taxed by the US on their worldwide income, not just US income. And if you were a green card holder, you are considered a resident until you file I-407, or there is otherwise a final administrative or judicial determination that you have lost residency.

This is my personal opinion and is not to be construed as legal advice.
