Hi,
I completed my Bachelors. I came to USA on Jan 10th 2005 on F1 visa for Masters degree and did not complet MS. I applied for the H1B visa in April 2005 H1B Quota. I got my H1 on OCT 2nd 2005 (I maintained F1 status until then). On 07/20/2007, I got my H1b transferred to another company and got my H1B until May 2010. When I applied for extension in May 2010, I got the extension until 2012 2nd OCT (By mistake or Luck). I have not gone out of the country since 2005 Jan. And I am planning to go for stamping this year.
H1B status started : OCT 2nd 2005
Got H1B extension Until : 2012 2nd OCT (which would be more than 6years)
I have not applied for Green card until now. My employer just started the process and I dont know when my Labour and I - 140 would be Approved.
My H1B status would complete 6 years by 2011 OCT.
If the Labour and I-140 are approved by 2011 OCT, I GUESS everything should be fine. If NOT
1)Can I still continue on the H1B after 2011 OCT even though my I-140 is not Approved?
2) Can I still continue the process of Green card after 2011 OCT Continuing on my H1B ?
3) OR do you want me to change my status to F1 or H4(I am married. My wife is on H1)? or any other options.
4)Will there be a problem if I go for stamping this year?
5) Will there be problem for my Green card or for my status?
Please Advise me what to do in this situation.
