  • Give away green card

    Hello,
    I am a green card holder and currently live in Asia but do not intend to return to the USA anymore for personal reasons. However, I continue to work as a contractor for a US company and for business reasons I need to travel once a year and work for a month or so onsite.
    Since I don't intend to return to the USA, I would like to give away the green card and apply for a VISA that will help me travel and work in the USA for a very short time(less than a month). I work as a freelance 'contractor' to the US company and do not work under any employer nor do I own a company.

    Please advise. Thanks for your time and help.

    u can do that. apply for a b1b2 visa and surrender your gc. or apply re entry permit

      I have a question for you. Since you had a green card and travelled to US once a year, which means you were absent from US for over 6 months per trip. Were you questioned at the port of entry, and if yes what kind of questions, what was your responce.

        I always had a valid reentry permit with me and gave it to the inspector along with my passport.
        I was always asked only one question - how long were you out of the USA and they stamped my reply(1 year or less) on the reentry permit as well as the passport.

        I haven't had any problems at the port of entry.

          Have you ever applied for re-entry permit one after another, in other words, once your re-entry permit expires, you apply for another one ?

            Yes, I have. I had successively applied for 3 reentry permits and received them. I have also been maintaining all things required to maintain the residency.
            I have now come to the point where I don't want to apply for another reentry permit and simply give away the green card and apply for a business visa instead.

              So what I understand is that you always travelled with the re-entry permit and not with the actual green card. Correct. Please advice.

                No, I always had my green card and presented it, along with my reentry permit and passport at the port of entry.

                  These 3 re-entry permits that you received continously, this is after they changed the rule where you have to do biometrics (finger print) for them, right ?

                  Did the officer at the airport ever ask you to show these ?
                  This is like tax return, family ties, property, etc ?

                    1. Yes, I had to stay in the US until I received and completed my biometrics appointment.
                    2. Yes, I filed taxes as resident, maintained my bank accounts, credit cards, driver's license.
                    3. No, I was never questioned on any of my ties with the USA. But, I always carried all relevant documents with me.
