Waiting for my green card abroad, Lost in the mail!

  • Waiting for my green card abroad, Lost in the mail!

    Hello,
    Im currently abroad for a vacation. My green card has been accepted August 5th, but it has been lost in the mail.
    Im now in big trouble to go back in the US because I dont have any paper to prove that Im a resident.
    I just filled an I90 form to replace it, but I read it can take up to 4months to have it back.
    Am I stuck abroad until I receive it, or is there a way for me to enter the US anyway (tourist visa?, or go to the US ambassy and say that I lost my green card?)

      Sorry I need to be more specific.
      So I got married in March 2011 (I was under a J1 visa until June 12 2011), I did all the process to get citizenship (adjustement of status I485), I also filled a I131 because I was planning to go on holidays.

      I received a temporary employement card in May.

      After that i got my marriage interview end of July (they took back my employement card at the interview). They told me I was approved and sent my green card August 5th (they never gave me any paper showing that i got approved, i only checked the status online that said that the card was in production, then sent).
      I left the country September 1st, thinking i was going to receive my green card (my roomate was supposed to send it to me in France).

      After a little bit i got worried, I called USCIS, they investigated and told me the card was lost in the mail and that I had to fill an I90 to get a replacement one. I read that its gonna take about 4months to get a new one.

      So now Im stuck abroad with no proof of my citizenship... And I have no clue about what to do.

        Having read your situation i cannot stop thinking that you brought all this upon yourself! Am sorry to break it to you but with so many irresponsible actions one after the other it was only a matter of time before something went wrong. You left the USA without thinking every little detail through and now you are in a bad situation!!!!

        First things first
        1) You are NOT a citizen just because you were approved for a green card. You are confused on that. I-485 is for adjustment of status of a non-immigrant to Legal Permanent Resident and yours was based on marriage.Green card means you are a Legal Permanent Resident of the USA. NOT A CITIZEN!!!!
        So NO you will not be asked to prove CITIZENSHIP at port of entry.
        BUT you WILL be asked to prove Legal Status. Hence the fuss about green cards, visas, visa waiver programs, etc!!!

        2) It really looks like you are stuck abroad!!! Are you a French national? EU citizen? You NEED the green card physically in your hands so as to hand over at the Immigration Officer at the port of entry to be admitted back in the USA. It is a requirement for all Green card holders when they leave the country for less than one(1) year. If your stay abroad is going to be longer than one year you need your Green Card and also a Re-entry permit issued to you PRIOR to travelling abroad. So my question is what were you thinking when you left the country WITHOUT a Green Card in your hands???????

        3)Are you the bread winner of your household? Did you travel abroad for vacation or business?
        What about your spouse? Why the card was to be sent to you by your roommate? Why the card was not sent to your house were you and your spouse live? Is your spouse your roommate? It really does not make sense why a third party (roommate) was involved and were given permission to handle your personal IMPORTANT documents!!! Complicated situation from the start. No need to be that complicated. Try to contact the American Embassy in France. Maybe you can do something on that end...

        Am not a lawyer and this is my personal opinion on a forum. Please use at your own risk
