visiting on b1/b2 visa after applying for I-130

    Hi there,

    I am from India.I have a B1/B2 visitor visa and my fiance has a green card.we are getting married in feb 2012.we are planning to apply for my I-130 after our marriage,
    but looking at current records it takes around 3 years to complete the whole process.I have my visitor visa till 2015.

    now my question is after applying for my I-130,Can i go and visit my husband and come back to india on visitor visa??

    how frequently I can do that??

    Is it going to create any problem at port of entry??

    I dont want do anything illegal.till i get my I-130 i just want to go to USA and spend some time with my husband.
    but I m not sure about how frequently i can travel to USA after we apply for my I-130.

        I have been following your posts, WHICH ARE ALL THE SAME QUESTION, and it seems you are not sure what to do next, apart from the fact that you are getting married. Congrats on that.

        First of all you need to realize that you cannot start every process available to you at this moment so as to immigrate to the USA. Some of the ways you are approaching this issue are FRAUD! and it is not tolerated. As you said you do not want to do anything illegal so take my advise and consider what your status is right now. Not which method will get you to the USA quickly. YOU CANNOT OUTSMART THE SYSTEM. And if you do think you can you will create problems with your immigration process which you do not want.

        From ALL your posts so far your intention is very clear! You want to be with your husband in the USA but you do not want to wait 3 years as you said. Your spouse to be is a green card holder, NOT an american citizen and therefore things are pretty straight forward for you.

        After marriage there is only one way you can pursue this and YES it will take a long time to come through and YES you can travel on your tourist visa to visit him while you wait in India for the Spouse visa or green card, whichever way you decide to do this. The Tourist Visa will be revoked at the time of your interview at the US Embassy or US Consulate when the time comes, NOT BEFORE THAT!!! You can come and go as a tourist with no intentions of overstaying as you please. No problems.But these are the only options you have THAT ARE LEGAL.

        Trying to initiate all methods and fill out all applications and start all procedures that can get you to the USA at the same time just complicates things and in the end you are DENIED. Simply because you are trying every way and method possible to immigrate!!!! And they are not stupid they can see your intentions clearly.

        Am guessing that his green card is employment based and therefore the company who sponsored him to get his green card can work with him to bring you over under his status. The company lawyers are more than capable to do this, am guessing.
