  • Re-entry permit

    Dear Immihelp:

I have a green card, I have a re-entry permit and now working abroad in France starting in June 2001 with the intention of returning and working/living in the U.S.

My two years are over in June 2003 but my permit expires in Dec 2003.

Is it possible for me to continue working in France until Dec 2003 (effectively being away from the states 2.5 years) or must I return by June 2003 to make sure I do not loose my ability to work and live in the U.S./loose my green card? Thank you.

    Re: Re-entry permit

It is my understanding that you have to return within the validity limit of the reentry permit. The 2-year limit comes about because that's the validity limit of the reentry permit.
I hope you know that you also have to file US taxes as resident. Filing as non-resident or not filing at all is a very strong indication that you abandoned your Greencard. See IRS Publication 519 (Tax Guide for Aliens) for details.
