  • Travelling Outside US with Pending I-751 (Remove Conditions from Permanent Resident)

    Hello,

I got my Conditional Green Card through Marriage on 10th May 2010 for 2 years. I have filled I-751 (Remove conditions from Permanent Residence) in February, 2012 and Received NOA by mail saying that "Your Permanent Resident is extended for One Year".

I would like to travel India so I went to Immigration office for Stamping on my Passport, Since my Green Card got expired in May 2012. The officer at the Immigration did not returned my Green Card and Put the Stamp on my passport with Expiry date 14th February, 2013. I asked her to return my GC but she said that we can not return it since it got expired but you can use this stamp in you passport as a GC.

The Thing happened at Immigration office is, She put stamp till 14th Feb, 2013 while according to the extension letter, It was saying for One year. Are they considering the One year of extension from the Date of receipt or from the date of GC expire?

Now I would like to Travel Outside US in November, 2012 and will be return on 1st December, 2012. Immigration officer told me that we Recommend to have at least six month of validity of your VISA while returning to US so I am not sure if they can bother you at the port of Entry while coming back, Since you have only 2 and half months left on your GC at the time of arrival.

I am confused what to do? Is it OK to travel with this situation outside of US? Are they going to create any Issue while coming back to US?

Please Reply to my thread if anyone has a knowledge or experience about this situation. I will really appreciate your response. Thanks in Advance.
