    I got laid off on H1B. My company has not informed INS about my lay-off.
    So officialli i am still legal because my I-94 will expire in Feb. 2011. I have a question about income tax return. Is there any risk in filing Income tax return, considering the fact that i am laid off and the amount on my W2 is very less comparative to my previous income tax return. Do INS has any connection with income tax department.
    Please advice.

    If you are laid off, you are out of status immediately, as soon as you get stopped paid.

    Your I-94 is no longer valid once you get laid off, as underlying H1 is no longer valid for you.

    Are you talking about filing 2009 tax return by April 15, 2010? Or 2010 tax return by April 15, 2011?

    As per IRS, they want your taxes whether you are legal or illegal, whether you earned money legally or illegally. They don't care about anything else such as your legal status etc.
