  • Dismissed prior to arraignment

    Hi,
    Firstly Please Advice( I know I did a stupid mistake which in my life I wont ever do anything that goes against the law)

    I was arrested and fingerprinted on a shoplifting case in MA.I had hired an attorney , we plead not guilty and i got my case dismissed prior to arraignment but with 20hours of community service. ( I have no prior arrests or any criminal records...this was my 1st and last stupidity)

    I had traveled out of United states and at the port of entry I had secondary where I was asked "Were you in any trouble in United states during your stay"
    I said yes and showed him the court copy which says about the case dismissal prior to arraignment on performing 20 hours of community service...the officer said it says u paid a fine by doing a community service and I had no answer...
    I was told not to get into any trouble in future and I was allowed to enter in the United states..

    My questions are:
    1.) I am on F1 visa currently, Will I have any issues getting H1B
    2.) Do I have any records in CORI? ( I read other forums which says if the case was dismissed was prior to arraignment then u dont have any CORI but I am not sure as I have performed community service)
    3.)Will I have any arrest records even though the case was dismissed prior to arraignment, If YES can it be expunged?
    4.) Will I have any issues getting any other countries VISA( Canada, UK,etc)
    5.)Will anything be shown on my Record if any background check occurs while employment,etc.

    People who can comment on the Questions with prior case knowledge kindly help...Appreciate it!

    1. Doubtful since you didn't serve any jail time and it doesn't sound like you were even convicted.
    2. Sorry, I don't know what CORI is.
    3. You definitely have an arrest record with the local authorities since they arrested you. Whether they reported this to the FBI (and thus will it appear on your RAP sheet) is unknown unless you obtain a copy of your RAP sheet. Also, expungements do not erase erase criminal records, they only modify convictions.
    4. I suggest you ask representatives of the other countries.
