  • Shoplifting case....Please Help

    I got caught for shoplifting for worth amount 200$ and I paid 500$ as penalty and my court date is on November in NY.

    I am student and working in my OPT and my employer wants to file for H1 B.

    Could you please suggest me whether this open case will create problem for
    H1B approval. Police has taken my finger prints and this is my first offence.

    Should I wait for the decision of court and then file H1b?

    I would be thankful to you for your suggestions which is very important to me.

    First of all, paying a fine is acceptance of guilt and it resulted in a conviction if the fine was paid in court.

    Shoplifting is a CIMT and you need to talk to a good lawyer having knowlegde of immigration consequences as a plea bargain cannot be so useful for an immigrant as a US Citizen.

    You will have problems with visas and everything else in the future as CIMTs are serious. Research more on the web and get a good lawyer that can try to get the case dismissed or reduced to a lesser charge of tresspassing or loitering.

      Could you please let me know for H1B filing this case will create issue as while going through forums I came to know that during visa stamping it would be an issue.

        H1b may not be an issue but could turn out to be if you get picked for a back ground check or random check.
