    Hi All,

    My husband is on L1 visa and I am on L2 visa. I had applied for EAD for which we require marriage certificate. Now we did not register our marriage in India and though we got the marriage registered with the Indian Consulate in US, its said to be insufficient proof of marriage by USCIS.

    Please guide.

    USCIS normally assumes the policy that civil events (births,marriages,divorces,deaths,etc.) are registered at the equivalent of a Civil Registrar in most countries. If the equivalent of a "civil registration" is not available, and there is no documented proof that the absence of records is due to war or other calamaties, USCIS will accept affidavits from civil authorities explaining reasons for the absence of documents but affiriming that the event (birth, divorce, etc.) did occur,based on personal knowledge of the affiant, or other alternative documents (baptism certs, etc.). If such reasonably completed affidavits from an official in the area of the event are not available, USCIS may take the stand that the event did not occur (at least as reported by the petitioner). An Embassy registration of a marriage outside the U.S. would be a very questionable proof of that event.

    In some countries there is no such thing as "divorce," i.e., Philippines, excepting Muslim divorces by Shaira law; Ireland and Malta, until very recently. Home births are often not reported to civil authorities for years.

      Thanks for your reply.

      In case marriage registration from US Indian consulate is not acceptable, what can be done further.

        Your best option might be to obtain a notarized affidavit from the person who officiated the marriage when it took place.

          Hi mr. Ray, i'm above 21 and my mother (green card holder) applied f2b for me and my siblings last january 2014 and a letter came that petition has been approved last september 2014. I would like to know, how long will it take for our visa no. To arrive? And when will the medical should start? (Sorry,cant find thread about f2b)

                  oh! didn't know it would take that long.they said obama made it possible to make it fast. im probably dead after 11yrs. i guess i have time to think wether to shoot my brains out or not.too long before i can see my family. thanx anyways.
