    No problem.Yeah mine is L1A.I do not know really the format of a cover letter ? Do you know whats it like? I shall speak with my employer and try to manage one.But I surely do not have I-129.

      The I-129 is the application that you submitted/or comapny submitted onyour behalf to uSCIS. You should either have an approval letter on that or the a copy of the blanket approval given to the comapny but you need some proof that you were in fact granted L status by USCIS.

      The companys attorney would know what to put in the cover letter and basicllay its an updated one they used in support of th e original application.

      Take a day off and breathe then think about it again. Just dont do anyhting which will kill all hope of reenetering in the future

        Thanks for everything ! I shall try to manage I-129.My priority date is July 05 and it has reached .Hence no time to take any breaks.Whatever I have to I hv to do asap.

        Coz if my approval for AOS comes in when my visa does then the visa itself gets nullified.

        Will keep you informed.

          O.k I didn't know you had reached your priority date. well don't do anyhting foolish in trying to get the L . See if you can get the Consular processing but that I cannot help you with. you case might not be as bad as you first feared nad you might be able to stay there and get the visa. keep me posted!

            No am not planning to do anything illegal.Have contacted an attorney.Lets see what he has to say.

              Curiousone,

              I have tried to get hold of few lawyers.No one is taking any interest.Can you suggest few names.

              Also what incase if me and my wife enters US on a B1/B2 and switch to an EAD .....is that a possibility ?

                Curious one,

                What are my termination benefits ? Will the employer has to pay for the transportation and any other stuff when he terminates somebody on L1A managerial position ?

                  ......thats not acut and dry issue.........you might think your employment was unjustly/illegally terminated when it fact it wasnt from alegal stand point...........also many states have 'employment at will" which allows for termination for no special reason............whethe ror not u were unjustly terminated would depend on the term sof your employment contract.......

                  I'm not sure I understnd your question on the transportation issue..........but I would think no, they didnt send you to India so that would be on you......


                  Why have you dismissed the possibility of waiting there for consular processing?

                    I havent dismissed the consular processing aspect.My lawyer is busy finding if I can do it in my case.Infact , I have already found a prospective employer who will do Consular for me.

                    Question is can I show that I travelled to India to switch an employer ? File an AC-21 then and wait for I485 to be approved.File an I824 and get the Consular done.Meanwhile, I will have to work for new employer in the same role and capacity...Key question here is can I still use my EAD in India to work for a US based company ??? Whats my wife's status in this case.

                    Let me know if you can shed some light on this.

                      I dont know the answer to your first question

                      I am assuming that you're Indian and if you're in India why would u need an EAD?....

                      Your wife B1/B2 remains intact but as regards her L status........whatever your is , hers is also

                      I wish someone else on this forum would help you out though just in case I dont have all the answers to your questions and frankly I don't...........
