I-140 and I-485

If the I-140 and I-485 get denied or rejected then what is the status of the person in the US? And accordingly what can the person do to be in status for both the principal applicant and the derivative applicant?

If they have a valid H1B visa (and have maintained status) they fall back onto that. Otherwise, they are out of status. They can not "regain" it, specially if they fall out of H1B status.
