EAD Notice of Approval

Hi,

Here is my timeline:

Employment Based Green Card Application

All sent to Texas Service Center

Applied for L.Cert: 2/23/2003
Approved L.Cert: 7/3/2007 (after initial denial on 8/28/06)
Applied for I-140, I-485 (concurrent), I-131, I-765: 8/07
Receipt Dates for: I-485, I-131, I-765: 8/6/07
Notice dates for: I-485, I-131, I-765: 10/3/07
Approval for EAD: 10/23/07
All others are currently pending at this time

My question is: Since my EAD has already been approved does this mean my
I-140 has been approved? I have not recieved anything regarding the I-140.

EAD approval depends on filing I-485 not I-140 approval.

So you nay have to wait for I-140 approval. With concurrent filing and the current workload it may be some time before you get I-140 approved, so as a precaution dont start using EAD right now.

Thank you for your quick reply.

I am currently on a H1-B yearly extension. In fact I am waiting for my latest extension which was recieved 8/7/07.

So, I am going for my Biometrics this coming Saturday in RI. I have already recieved my approval notice for my EAD. Now, is the issuance of my EAD dependent upon the Biometrics??

No, if you see the EAD card it will state in the fingerprint area "Not Available" and next EAD will have this.

Thank you again. I can't believe that I have waited so long (not as long as others though) for this process to finally begin. Hopefully the approval of the EAD is some good news for everything else!!

One other thought........since my EAD has been approved......does that mean my I-485 is on its way to being approved?? I keep on having these random thoughts pop into my head everytime I read more posts here!!

only if the PD is current according to this bulleting you did not metion if you were EB3 or EB2

Hi,

I am on EB 3. I got my EAD in the mail yesterday And my fingerprints will be done tomorrow. According to my lawyer I should expect my AP in the next few weeks. He also mentioned that I may have to wait a while for the I-485 approval.
