  • EAD - H1 - Pros and Cons

    Hi,
    I was on L1 with Company A. I filed for H1 from company B which got approved this august. Parallely, as a dependent on my husbands GC process, i filed for EAD & 485. My EAD is approved and i have the card.

    I quit company A from 1st Oct and was looking for a project through company B. I have not yet got my H1 stamped for company B. Now after a month i still have not started a project through company B. Yesterday, I received my EAD.

    My questions are,
    1. Shall i join company C on my EAD or shall i stick with company B and stay on H1.

    2. If i stick with H1, will my EAD expire or be unusable any time in the future ?

    3. If i move to EAD, will my H1 be invalid and unusable any time in the future ?

    Any help/suggestion to weigh my pros and cons will be very appreciated.

    1) you can use either, the only disadvantage of using EAD is that if for some reason your husbands I-485 id denied you lose it.

    2) EAD's if you look carefully is valid for a year from the date of issue, so it needs to be renewed timely atlaest 3-6 months in advance beacuse to work you need valid EAD in your possesion at all times.

    3) Your status will move to AOS from H1 the day you start using EAD, in fact since you are not really working at the moment on H1 I doubt you are legally on H1 anymore, especially if you are not being paid.

    You can easily invoke your h1 by getting a stamp abroad and enetering using H1.
